Selling Your House
Once you have instructed estate agents to market your house, the legal process of selling it is relatively straightforward:
- Having asked you to complete some standard forms about your property,
we will then prepare a contract and liaise with the purchasers'
solicitors on all matters leading up to the exchange of contracts
and finally to completion.
(If you are also buying a new house, we will work with all parties to have these dates coincide with those of your purchase) - If you have a mortgage, we will obtain the deeds to it from your lender, and obtain an up-to-date redemption figure.
- On completion of the sale, we will redeem your mortgage and send the Net proceeds of the sale to you, having settled our fees and those related to the mortgage and Estate Agents.
Buying Your House
Purchasing is a rather more involved process than selling, as we are always looking to ensure that the property which you are buying does not cause any unforeseen problems or ownership-related issues.
- Having been given instructions to act for you, we will firstly carry out as local search through the local authority. This enables us to identify any public works (such as road schemes) affecting the property, and any planning restrictions.
- Following arrangement of your mortgage, and the taking
of independent financial advice, you may wish to appoint a surveyor
to carry out a full survey, in addition to the survey required
by your bank or building society. We would recommend that a house
buyer's report be obtained.
(If defects are found, you may wish to withdraw from the purchase, or negotiate a lower price with the seller.) - Following receipt of written confirmation of your mortgage offer, and prepared all of the relevant paperwork, we can now exchange contracts. This takes place after the full deposit (usually 10% of the purchase price) is paid. Once contracts have been exchanged, the purchase is legally binding.
- We will then carry out all of the processes required prior to completion, including receipt of required funds from your bank or building society.
- On completion, the full purchase price is settled, documents of file are sent to us and the property is now yours.
- After completion we attend to stamp duty and registration of your property in your name at HM Land Registry. Your title deeds are then forwarded to your bank or building society and are kept by them until you either sell the property, or redeem your mortgage.
